Terms of Service

These Terms of Service (“Terms”) apply to heating, ventilation and air-conditioning (“HVAC”) services provided by Fabicool (“Fabicool,” “we,” “us,” or “our”), including inspections, diagnostics, maintenance, repairs, equipment replacement and installation.
By accepting an estimate, authorizing work, scheduling paid services or entering into a service agreement with Fabicool, the customer agrees to the applicable estimate or contract and these Terms, subject at all times to rights provided by applicable law.
Nothing in these Terms is intended to limit or waive any right or legal warranty that cannot lawfully be excluded or restricted under applicable consumer-protection legislation.
01Estimates and Quotations
Estimates and quotations are based on information reasonably available to Fabicool at the time they are prepared.
An estimate covers only the equipment, materials and work specifically identified in the estimate.
Concealed, inaccessible or unforeseen conditions may require additional work or costs. These may include defective electrical wiring, inadequate electrical service, damaged ductwork, drainage problems, structural conditions, concealed damage, inaccessible equipment, code deficiencies or other pre-existing conditions.
Where additional work is required, Fabicool will advise the customer and obtain authorization before proceeding where reasonably practicable.
02Service Calls and Diagnostics
A service or diagnostic fee may apply when a technician is dispatched to inspect, diagnose or troubleshoot an HVAC system.
Unless otherwise agreed, a diagnostic or service-call charge covers the technician's time and expertise and may remain payable if the customer chooses not to proceed with a repair, replacement is recommended, required parts are unavailable or a return visit is necessary.
Applicable charges will be communicated to the customer.
03Authorization of Work
Work will be performed according to the customer's accepted estimate, work order or other authorization.
Material changes to the agreed scope of work will be communicated to the customer and authorization obtained where reasonably practicable before additional work is performed.
04Appointments and Property Access
Customers are responsible for providing safe and reasonable access to the property and HVAC equipment.
Work areas should be reasonably accessible, pets should be secured and Fabicool should be informed of known hazards or unusual conditions.
If safe or reasonable access cannot be provided, an appointment may need to be rescheduled.
05Cancellations and Rescheduling
Fabicool asks customers to provide reasonable notice when cancelling or rescheduling appointments.
Any applicable cancellation charges will be disclosed and applied only as permitted by law.
Nothing in these Terms limits statutory cancellation or refund rights available under Quebec's Consumer Protection Act or other applicable legislation.
Where applicable law provides greater rights to the customer, applicable law will prevail.
06Equipment Installation
HVAC installations will be performed according to the scope described in the customer's accepted estimate or contract.
Unless expressly included, installation pricing does not automatically include unrelated or unforeseen electrical upgrades, structural modifications, extensive duct modifications, plumbing modifications, hazardous-material remediation, drywall or painting repairs, correction of previously non-compliant work or other work outside the agreed HVAC installation.
Additional work will be discussed with the customer where reasonably practicable before proceeding.
07Equipment and Material Availability
Equipment, replacement parts and materials are subject to manufacturer and supplier availability.
If specified equipment becomes unavailable, discontinued or significantly delayed, Fabicool may propose an appropriate alternative.
Any materially different equipment, specifications or pricing will be communicated to the customer for approval.
Fabicool is not responsible for manufacturer, distributor or transportation delays outside its reasonable control.
08Existing Systems and Pre-Existing Conditions
HVAC systems contain numerous interconnected mechanical, electrical and control components.
Repairing or replacing one component does not guarantee that another existing component will not subsequently fail.
Fabicool is not responsible for pre-existing defects or damage that was not caused by Fabicool, subject to applicable law.
If a potentially unsafe condition is discovered, Fabicool may recommend corrective work or decline to operate affected equipment until the condition has been appropriately addressed.
09Customer-Supplied Equipment
Fabicool may, at its discretion, agree to install equipment supplied by a customer.
Unless otherwise agreed, Fabicool does not provide a manufacturer's warranty for customer-supplied equipment and is not responsible for defects, incompatibility or missing components inherent in equipment supplied by the customer.
Fabicool remains responsible for the quality of the installation work it performs as required by applicable law.
10Manufacturer Warranties
HVAC equipment may be covered by warranties provided by its manufacturer.
Warranty periods and conditions vary by manufacturer, model and component.
Manufacturer warranties may not include labour, diagnostic charges, transportation or other services unless specifically stated.
Manufacturer warranties are separate from any Fabicool workmanship warranty and from legal warranties provided by law.
11Legal Warranties
Nothing in these Terms excludes or restricts warranties provided automatically under applicable Quebec law.
Products and services may benefit from legal warranties concerning fitness for their intended purpose, reasonable durability, conformity and protection against hidden defects.
These rights may apply independently of any manufacturer's or Fabicool warranty.
12Workmanship
Fabicool stands behind work performed by its technicians.
Any specific labour or workmanship warranty applicable to an installation or repair will be identified in the customer's estimate, invoice, contract or warranty documentation.
A workmanship warranty does not cover problems caused by circumstances unrelated to Fabicool's work, including subsequent damage, misuse, lack of maintenance, modifications performed by others, abnormal operating conditions or failure of unrelated components.
This provision does not restrict rights provided by applicable law.
13Maintenance and System Performance
HVAC equipment requires appropriate maintenance to maintain efficiency, reliability and service life.
Customers are responsible for routine maintenance appropriate to their equipment unless those services are included in a Fabicool maintenance agreement.
Fabicool cannot guarantee specific energy savings, operating costs or equipment life unless expressly guaranteed in writing.
Actual performance may be affected by weather, building construction, insulation, ductwork, thermostat settings, maintenance, occupancy and other factors outside Fabicool's control.
14Permits, Codes and Regulations
Where required and included within the agreed scope, work will be performed in accordance with applicable codes and regulatory requirements.
Existing installations or building conditions that do not comply with current requirements may require additional corrective work.
Responsibility for permits or inspections may be identified in the applicable estimate or contract.
15Safety
Fabicool reserves the right to stop or refuse work where conditions reasonably present a danger to customers, occupants, property or Fabicool personnel.
Work may resume once the unsafe condition has been appropriately addressed.
16Payment
Payment terms will be specified on the applicable estimate, work order, invoice or contract.
Depending on the project, deposits, progress payments or payment upon completion may be required, subject to applicable law.
Applicable taxes will be charged where required.
Any fees relating to overdue accounts, returned payments or collection costs will apply only where disclosed and permitted by law.
17Scheduling and Delays
Fabicool will make reasonable efforts to perform work according to agreed scheduling.
Circumstances outside Fabicool's reasonable control may affect scheduling, including severe weather, equipment or parts shortages, supplier delays, transportation disruptions, emergency service calls, utility interruptions or unexpected site conditions.
Material scheduling changes will be communicated as reasonably practicable.
18Property Protection
Fabicool technicians will take reasonable care while working at a customer's property.
Customers should identify known fragile, concealed or unusual conditions before work begins.
Fabicool is not responsible for pre-existing damage or damage resulting from concealed conditions that could not reasonably have been identified beforehand, except where responsibility arises under applicable law.
Nothing in these Terms limits responsibility for damage caused by Fabicool where such liability cannot legally be excluded.
19Emergency and After-Hours Service
Emergency and after-hours service may be available depending on technician availability.
Additional charges may apply for emergency, evening, weekend or statutory-holiday service.
Fabicool cannot guarantee a particular emergency response time unless expressly agreed in writing.
In an immediate emergency involving fire, gas, carbon monoxide or another life-safety hazard, customers should contact the appropriate emergency service.
20Photographs and Service Documentation
Fabicool technicians may photograph equipment, installations, model and serial numbers, deficiencies and work areas when reasonably necessary to document services, prepare estimates or maintain service records.
Use of identifiable customer property for advertising or promotional purposes will require appropriate authorization where required.
21Third-Party and Manufacturer Services
Certain warranty claims, specialized repairs, equipment commissioning or other services may involve manufacturers, distributors or appropriately qualified third parties.
Fabicool is not responsible for delays or decisions made independently by these third parties except to the extent responsibility arises under applicable law.
22Privacy
Personal information collected in connection with estimates, appointments, installations, billing and customer service will be handled in accordance with Fabicool's Privacy Policy and applicable privacy legislation.
23Website Information
Information provided on the Fabicool website is for general informational purposes.
Website information does not replace a site inspection, professional diagnosis or written estimate.
Pricing, promotions, equipment availability and services may change.
A customer's specific quotation or written contract will govern the particular work being performed.
24Consumer Rights
These Terms must be interpreted in accordance with applicable law.
If a provision conflicts with mandatory consumer-protection legislation, the applicable legal requirement will prevail.
Nothing in these Terms is intended to exclude, restrict or diminish any legal warranty, remedy or consumer right that cannot lawfully be waived.
25Governing Law
For services provided in Quebec, these Terms are governed by the laws applicable in the Province of Quebec and the federal laws of Canada applicable therein, subject to mandatory consumer-protection rules concerning jurisdiction or applicable law.
26Changes to These Terms
Fabicool may update these Terms periodically.
Updates posted to the website will not retroactively alter an existing customer agreement where prohibited by law.
